「PSHARE」是由杭州泊享网络科技有限公司（以下简称“泊享网络”）开发运营的智能停车APP。主要功能包含但不限于：用户可控制一个或多个蓝牙车位锁，并按时段分享给其他用户。 请认真阅读本《用户协议》（以下简称“协议”），确保您充分理解本协议中各条款。您的注册、登录、使用等行为将视为对本协议的接受，并同意接受本协议各项条款的约束。
1、用户在使用本服务前需要注册一个“PSHARE”账号。“PSHARE”账号应当使用手机号码绑定注册，请用户使用尚未与“PSHARE”账号绑定的手机号码注册。泊享网络可以根据用户需求或产品需要对账号注册和绑定的方式进行变更，而无须事先通知用户。
2、鉴于“PSHARE”账号包含手机绑定注册方式，您同意泊享网络在注册时将使用您提供的手机号码等信息用于注册。
1、本服务的具体内容由泊享网络根据实际情况提供，包括但不限于用户所拥有蓝牙车位锁的升降控制，并可按时段分享给其他用户。
2、泊享网络提供的服务为免费服务。
1、尊重用户个人隐私信息的私有性是泊享网络的一贯制度，泊享网络将采取技术措施和其他必要措施，确保用户个人隐私信息安全，防止在本服务中收集的用户个人隐私信息泄露、毁损或丢失。在发生前述情形或者泊享网络发现存在发生前述情形的可能时，将及时采取补救措施。
2、泊享网络未经用户同意不向任何第三方公开、 透露用户个人隐私信息。但以下特定情形除外：
(1) 泊享网络根据法律法规规定或有权机关的指示提供用户的个人隐私信息；
(2) 由于用户将其用户密码告知他人或与他人共享注册帐户与密码，由此导致的任何个人信息的泄漏，或其他非因泊享网络原因导致的个人隐私信息的泄露；
(3) 用户自行向第三方公开其个人隐私信息；
(4) 用户与泊享网络及合作单位之间就用户个人隐私信息的使用公开达成约定，泊享网络因此向合作单位公开用户个人隐私信息；
(5) 任何由于黑客攻击、电脑病毒侵入及其他不可抗力事件导致用户个人隐私信息的泄露。
3、用户同意泊享网络可在以下事项中使用用户的个人隐私信息：
(1) 泊享网络向用户及时发送重要通知，如软件更新、本协议条款的变更；
(2) 依本协议约定，泊享网络管理、审查用户信息及进行处理措施；
(3) 适用法律法规规定的其他事项。
除上述事项外，如未取得用户事先同意，泊享网络不会将用户个人隐私信息使用于任何其他用途。
泊享网络提供的服务中可能包括广告，用户同意在使用过程中显示泊享网络和第三方供应商、合作伙伴提供的广告。除法律法规明确规定外，用户应自行对依该广告信息进行的交易负责，对用户因依该广告信息进行的交易或前述广告商提供的内容而遭受的损失或损害，泊享网络不承担任何责任。
1、 “PSHARE”账号的所有权归泊享网络所有，用户完成申请注册手续后，获得“PSHARE”账号的使用权，该使用权仅属于初始申请注册人，禁止赠与、借用、租用、转让或售卖。泊享网络因经营需要，有权回收用户的“PSHARE”账号。
2、用户可以更改、删除“PSHARE”帐户上的个人资料，但需注意，用户需承担该风险。
3、用户有责任妥善保管注册账号信息及账号密码的安全，因用户保管不善可能导致遭受盗号或密码失窃，责任由用户自行承担。用户需要对注册账号以及密码下的行为承担法律责任。用户同意在任何情况下不使用其他用户的账号或密码。在用户怀疑他人使用其账号或密码时，用户同意立即通知泊享网络。
4、用户应遵守本协议的各项条款，正确、适当地使用本服务，如因用户违反本协议中的任何条款，泊享网络在通知用户后有权依据协议中断或终止对违约用户“PSHARE”账号提供服务。同时，泊享网络保留在任何时候收回“PSHARE”账号、用户名的权利。
5、“PSHARE”账号的所有权归泊享网络所有，用户完成申请注册手续后，获得“PSHARE”账号的使用权，该使用权仅属于初始申请注册人，禁止赠与、借用、租用、转让或售卖。
1、除本服务中涉及广告的知识产权由相应广告商享有外，泊享网络在本服务中提供的内容（包括但不限于网页、文字、图片、音频、视频、图表等）的知识产权均归泊享网络所有，但用户在使用本服务前对自己发布的内容已合法取得知识产权的除外。
2、除另有特别声明外，泊享网络提供本服务时所依托软件的著作权、专利权及其他知识产权均归泊享网络所有。
3、泊享网络在本服务中所涉及的图形、文字或其组成，以及其他泊享网络标志及产品、服务名称（以下统称“泊享网络标识”），其著作权或商标权归泊享网络所有。未经泊享网络事先书面同意，用户不得将泊享网络标识以任何方式展示或使用或作其他处理，也不得向他人表明用户有权展示、使用、或其他有权处理泊享网络标识的行为。
4、上述及其他任何泊享网络或相关广告商依法拥有的知识产权均受到法律保护，未经泊享网络或相关广告商书面许可，用户不得以任何形式进行使用或创造相关衍生作品。
1、用户理解并确认，在使用本服务的过程中，可能会遇到不可抗力等风险因素，使本服务发生中断。不可抗力是指不能预见、不能克服并不能避免且对一方或双方造成重大影响的客观事件，包括但不限于自然灾害如洪水、地震、瘟疫流行和风暴等以及社会事件如战争、动乱、政府行为等。出现上述情况时，泊享网络将努力在第一时间与相关单位配合，及时进行修复，但是由此给用户或第三方造成的损失，泊享网络及合作单位在法律允许的范围内免责。
2、本服务同大多数互联网服务一样，受包括但不限于用户原因、网络服务质量、社会环境等因素的差异影响，可能受到各种安全问题的侵扰，如他人利用用户的资料，造成现实生活中的骚扰；用户下载安装的其它软件或访问的其他网站中含有“特洛伊木马”等病毒，威胁到用户的计算机信息和数据的安全，继而影响本服务的正常使用等等。用户应加强信息安全及使用者资料的保护意识，要注意加强密码保护，以免遭致损失和骚扰。
3、用户理解并确认，本服务存在因不可抗力、计算机病毒或黑客攻击、系统不稳定、用户所在位置、用户关机以及其他任何技术、互联网络、通信线路原因等造成的服务中断或不能满足用户要求的风险，因此导致的用户或第三方任何损失，泊享网络不承担任何责任。
4、用户理解并确认，泊享网络需要定期或不定期地对“PSHARE”平台或相关的设备进行检修或者维护，如因此类情况而造成服务在合理时间内的中断，泊享网络无需为此承担任何责任。
5、用户理解并确认，对于泊享网络向用户提供的下列产品或者服务的质量缺陷及其引发的任何损失，泊享网络无需承担任何责任：(1) 泊享网络向用户免费提供的服务；(2) 泊享网络向用户赠送的任何产品或者服务。
6、在任何情况下，泊享网络均不对任何间接性、后果性、惩罚性、偶然性、特殊性或刑罚性的损害，包括因用户使用“PSHARE”或本服务而遭受的利润损失，承担责任（即使泊享网络已被告知该等损失的可能性亦然）。尽管本协议中可能含有相悖的规定，泊享网络对用户承担的全部责任，无论因何原因或何种行为方式，始终不超过用户因使用泊享网络提供的服务而支付给泊享网络的费用(如有)。
1、泊享网络郑重提醒用户注意本协议中免除泊享网络责任和限制用户权利的条款，请用户仔细阅读，自主考虑风险。未成年人应在法定监护人的陪同下阅读本协议。
2、本协议的效力、解释及纠纷的解决，适用于中华人民共和国法律。若用户和泊享网络之间发生任何纠纷或争议，首先应友好协商解决，协商不成的，用户同意将纠纷或争议提交泊享网络住所地有管辖权的人民法院管辖。
3、本协议的任何条款无论因何种原因无效或不具可执行性，其余条款仍有效，对双方具有约束力。
"Pshare" is an intelligent parking app developed and operated by Hangzhou PSHARE NETWORK Technology Co., Ltd. (hereinafter referred to as "PSHARE NETWORK"). The main functions include but are not limited to: users can control one or more Bluetooth parking locks and can share them with other users according to the time period. Please read this user agreement (hereinafter referred to as the "agreement") carefully to ensure that you fully understand the terms of this agreement. Your registration, login and use will be deemed as acceptance of this agreement, and you agree to be bound by the terms of this agreement.
1、Users need to register a "pshare" account before using this service. "Pshare" account should be registered with mobile phone number binding. Please use the mobile phone number that has not been bound with "pshare" account. The way of account registration and binding can be changed according to the needs of users or products without prior notice to users.
2、As the "pshare" account contains the mobile phone binding registration method, you agree that PSHARE will use the mobile phone number and other information provided by you for registration.
1、The specific content of this service is provided by PSHARE NETWORK according to the actual situation, including but not limited to the rise/fall control of the Bluetooth parking lock owned by the user, and can be shared with other users according to the time period.
2、The service provided by PSHARE NETWORK is free of charge.
1、Respecting the privacy of users' personal privacy information is the consistent system of PSHARE NETWORK. PSHARE NETWORK will take technical measures and other necessary measures to ensure the security of users' personal privacy information and prevent the leakage, damage or loss of users' personal privacy information collected in this service. In case of the above-mentioned situation or the possibility of the occurrence of the above-mentioned situation found by PSHARE NETWORK, remedial measures will be taken in time.
2、PSHARE NETWORK will not disclose the user's personal privacy information to any third party without the user's consent. But except for the following specific circumstances:
(1) PSHARE NETWORK provides users' personal privacy information according to laws and regulations or the instructions of competent authorities;
(2) The disclosure of any personal information caused by the user's informing others or sharing the registered account and password with others, or the disclosure of personal privacy information not caused by PSHARE NETWORK;
(3) Users disclose their personal privacy information to a third party by themselves;
(4) The agreement on the use and disclosure of user's personal privacy information has been reached between users and PSHARE NETWORK and cooperative units. Therefore, PSHARE NETWORK discloses users' personal privacy information to cooperative units;
(5) Any leakage of user's personal privacy information due to hacker attack, computer virus invasion and other force majeure events.
3、Users agree that PSHARE NETWORK can use user's personal privacy information in the following matters:
(1) PSHARE NETWORK sends important notices to users in time, such as software updates and changes in the terms of this agreement;
(2) In accordance with this agreement, PSHARE NETWORK manages and makes user information review and processing measures;
(3) Other matters stipulated by applicable laws and regulations.
In addition to the above, PSHARE NETWORK will not use the user's personal privacy information for any other purposes without the user's prior consent.
The services provided by PSHARE NETWORK may include advertisements. Users agree to display advertisements provided by PSHARE NETWORK and third-party suppliers and partners during the use process. Unless otherwise specified by laws and regulations, users shall be responsible for the transactions conducted in accordance with the advertising information, and PSHARE NETWORK shall not be liable for any loss or damage suffered by users due to the transactions conducted in accordance with the advertising information or the content provided by the above-mentioned advertisers.
1、 The ownership of the "pshare" account belongs to PSHARE NETWORK. After completing the registration application procedures, the user can obtain the right to use the "pshare" account. The right to use the account belongs to the initial applicant, and it is prohibited to donate, borrow, rent, transfer or sell. PSHARE NETWORK has the right to reclaim the user's "pshare" account number due to business needs.
2、Users can change and delete their personal data in the" pshare "account, but it should be noted that users should bear the risk.
3、The user is responsible for keeping the security of the registered account information and account password properly. The user may suffer from theft of the account number or password due to improper storage, and the responsibility shall be borne by the user. Users need to bear legal responsibility for the behavior under the registered account and password. The user agrees not to use the account or password of other users under any circumstances. When the user suspects that other people use his account or password, the user agrees to inform PSHARE NETWORK immediately.
4、The user shall abide by the terms of this Agreement and use the service correctly and properly. If the user violates any of the terms of this agreement, PSHARE NETWORK has the right to interrupt or terminate the service to the "pshare" account of the defaulting user according to the agreement after notifying the user. At the same time, PSHARE NETWORK reserves the right to take back the "pshare" account and user name at any time.
5、The ownership of the "pshare" account belongs to PSHARE NETWORK. After completing the registration application procedures, the user can obtain the right to use the "pshare" account. The right to use the account belongs to the initial applicant, and it is prohibited to donate, borrow, rent, transfer or sell.
1、In addition to the intellectual property rights related to advertising in this service, the intellectual property rights of the content (including but not limited to web pages, text, pictures, audio, video, charts, etc.) provided by PSHARE NETWORK in this service belong to PSHARE NETWORK, except that users have legally obtained intellectual property rights for the content they publish before using the service.
2、Unless otherwise stated, the copyright, patent right and other intellectual property rights of the software relied on by PSHARE NETWORK to provide this service belong to PSHARE NETWORK.
3、The copyright or trademark rights of the graphics, words or their composition involved in the service, as well as other PSHARE NETWORK signs, product and service names (hereinafter referred to as " PSHARE NETWORK LOGO") shall be owned by PSHARE NETWORK. Without the prior written consent of PSHARE NETWORK, the user shall not display or use the PSHARE NETWORK LOGO in any way or make any other treatment, and shall not indicate to others that the user has the right to display, use, or otherwise have the right to handle the PSHARE NETWORK LOGO.
4、The intellectual property rights of the above and any other related advertisers shall be protected by law. Users shall not use or create derivative works in any form without the written permission of PSHARE NETWORK or related advertisers.
1、The user understands and confirms that in the process of using the service, it may encounter force majeure and other risk factors, which may cause the service to be interrupted. Force majeure refers to the objective events that cannot be foreseen, overcome and avoided, and have a significant impact on one or both parties, including but not limited to natural disasters such as floods, earthquakes, epidemics and storms, and social events such as war, turmoil, and government actions. In case of any of the above situations, PSHARE NETWORK will try to cooperate with relevant units as soon as possible and repair them in a timely manner. However, any loss caused to users or third parties shall be exempted from liability within the scope permitted by law.
2、Like most Internet services, this service is affected by, but not limited to, user reasons, network service quality, social environment and other factors, and may be invaded by various security issues, such as other people's use of user's information to cause real-life harassment; users download and install other software or visit other websites contain "Trojan horse" and other viruses, It threatens the security of user's computer information and data, and then affects the normal use of this service. Users should strengthen the awareness of information security and user data protection, and pay attention to strengthen password protection to avoid loss and harassment.
3、The user understands and confirms that there is a risk of service interruption or failure to meet the user's requirements due to force majeure, computer virus or hacker attack, system instability, user's location, user's shutdown, and any other technical, Internet, communication line reasons, etc., PSHARE NETWORK will not be responsible for any loss of the user or the third party.
4、The user understands and confirms that the "pshare" platform or related equipment needs to be overhauled or maintained regularly or irregularly. If the service is interrupted within a reasonable time due to such circumstances, PSHARE NETWORK does not need to bear any responsibility for this.
5、The user understands and confirms that for the quality defects of the following products or services provided by PSHARE NETWORK to users and any losses caused by them, PSHARE NETWORK shall not be liable for: a. the services provided free of charge by PSHARE NETWORK to users; b. any products or services presented by PSHARE NETWORK to users.
6、In any case PSHARE NETWORK shall not be liable for any indirect, consequential, punitive, incidental, special or punitive damages, including loss of profits suffered by users due to the use of "pshare" or the service (even if PSHARE NETWORK has been informed of the possibility of such loss). Notwithstanding any provision to the contrary contained in this agreement, the total liability of PSHARE NETWORK to the user, for whatever reason or manner of conduct, shall not exceed the fee (if any) paid by the user to PSHARE NETWORK for the use of the services provided by PSHARE NETWORK.
1、PSHARE NETWORK solemnly reminds users to pay attention to the terms of exempting PSHARE NETWORK responsibility and restricting users' rights in this agreement. Users are requested to read carefully and consider risks independently. Minors should read this agreement in the company of their legal guardians.
2、The validity, interpretation and dispute settlement of this Agreement shall be governed by the laws of the people's Republic of China. In case of any dispute or dispute between the user and PSHARE NETWORK, it shall be settled through friendly negotiation. If the negotiation fails, the user agrees to submit the dispute or dispute to the people's court with jurisdiction in the place where PSHARE NETWORK is located.
3、Any provision of this Agreement shall be invalid or unenforceable for any reason, and the remaining provisions shall remain valid and binding on both parties.
